1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you and Profitability IRL, operated by Cultivate Media Co LLC ("Company," "we," "us," or "our"). By accessing our websites at cultivatemade.com or profitabilityirl.com, enrolling in any program tier, or using any of our services, you agree to be bound by these Terms in their entirety.

If you do not agree to these Terms, please do not access our websites or enroll in our programs. We reserve the right to update these Terms at any time, and your continued use of our services constitutes acceptance of any changes.

2. About Profitability IRL

Profitability IRL is a business education program designed to help entrepreneurs, creatives, veterans, and service providers build profitable, sustainable businesses with integrity. All program content, modules, and community access are hosted exclusively on our website at profitabilityirl.com. The program currently offers three tiers:

Entrepreneur Launch Pad (Free): A foundational mini-course introducing business fundamentals, boundary concepts, and our signature B.O.U.N.D.A.R.Y. System™, along with access to our free community and weekly resources.
Foundations (97 or 3 x 97): A 6-week intensive program covering all core modules, weekly group coaching calls, implementation workbooks, templates, and 6 months of community access post-program.
Elite (,997 or 6 x 97): A 12-month personalized program including everything in Foundations plus one-on-one strategy sessions, custom business audits, Voxer access, and elite mastermind access.

3. Program Access & Account Responsibilities

All program content is delivered exclusively through our website at profitabilityirl.com. When you enroll in any program tier, you agree to:

Provide accurate, current, and complete registration and payment information
Keep your login credentials confidential and not share access with others
Notify us immediately of any unauthorized use of your account
Take responsibility for all activities that occur under your account

Program access is personal and non-transferable. Sharing your account login or program materials with others is prohibited and may result in termination of your enrollment without refund.

4. Payment Terms

Pricing & Payment Plans

Paid program tiers are available as single payments or payment plans as listed above. By selecting a payment plan, you authorize us to charge your payment method on the agreed schedule. All prices are in U.S. dollars.

Failed Payments

If a payment fails, we will notify you and attempt to process the payment again. If payment cannot be collected, your access to program materials may be suspended until the balance is resolved.

Taxes

You are responsible for any applicable taxes associated with your purchase. We will collect sales tax where required by law.

5. Refund Policy

Free Tier

The Entrepreneur Launch Pad is free of charge. No refunds are applicable.

Foundations Program

We offer a 7-day satisfaction review period beginning from the date of your enrollment confirmation. If, within 7 days, you have reviewed the program and do not feel it is the right fit, you may request a refund by contacting us at profitabilityirl.com. After the 7-day period, all sales are final.

If you are on a payment plan and request a refund within the 7-day window, only the initial payment collected will be refunded and the remaining payments will be cancelled.

Elite Program

Due to the personalized and high-touch nature of the Elite program, all sales are final once the first one-on-one strategy session has been completed. If you have not yet completed your first session, you may request a refund within 7 days of enrollment by contacting us directly.

Exceptions

Refunds will not be issued for failure to participate, failure to complete program modules, or dissatisfaction based on results that depend on individual effort and implementation. Results will vary based on individual circumstances, commitment, and application of program content.

6. Intellectual Property

Our Content

All content on our websites and within our programs, including but not limited to curriculum materials, workbooks, templates, the B.O.U.N.D.A.R.Y. System™, coaching call recordings, brand assets, written content, and video content, is the intellectual property of Profitability IRL / Cultivate Media Co LLC and is protected by copyright, trademark, and other applicable laws.

License to You

Upon enrollment, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the program materials for your personal business education purposes only. You may not:

Reproduce, distribute, resell, or create derivative works from our program materials
Share your login credentials or program content with non-enrolled individuals
Use our content, frameworks, or proprietary systems (including the B.O.U.N.D.A.R.Y. System™) in your own courses, workshops, or training programs without written permission
Record group coaching sessions without the prior written consent of all participants and the program facilitator
Download, copy, or redistribute any portion of program content hosted on profitabilityirl.com

Your Content

You retain ownership of any content, business ideas, or materials you create during the program. By participating in group calls or community spaces, you grant us a limited license to reference your progress or questions in educational contexts without identifying you personally.

If you provide a testimonial or agree to a case study, you grant us a non-exclusive license to use your story in our marketing materials. You may withdraw this permission with 30 days' written notice.

7. Community Standards & Conduct

Profitability IRL cultivates a safe, collaborative community for entrepreneurs. By participating in any community space, group call, or program interaction, you agree to:

Treat all participants, facilitators, and staff with respect and dignity
Maintain confidentiality of what other participants share in group settings — do not share others' personal stories, business information, or vulnerabilities outside the community
Refrain from spam, solicitation, or self-promotion within community spaces unless expressly permitted
Refrain from discriminatory, harassing, abusive, or threatening behavior of any kind
Refrain from sharing unlawful, defamatory, or harmful content

We reserve the right to remove any participant from community spaces or the program entirely, without refund, for violations of these community standards.

8. Educational Disclaimer

Profitability IRL provides business education, coaching, and community support. Our program content is for educational and informational purposes only.

We are not licensed attorneys, accountants, financial advisors, therapists, or mental health professionals.
Nothing in our program constitutes legal, financial, tax, or therapeutic advice.
Business results depend on many factors including your individual effort, experience, market conditions, and implementation. We make no guarantees of specific financial outcomes or results.
While our program incorporates trauma-informed principles and may reference healing journeys, it is not a substitute for professional mental health treatment. We encourage participants to seek appropriate professional support as needed.
References to faith, biblical principles, and spiritual practices are offered as optional frameworks and are not required for program participation or success.

9. Limitation of Liability

To the fullest extent permitted by law, Profitability IRL, Cultivate Media Co LLC, and their founders, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your participation in our programs or use of our websites. Our total liability for any claim arising under these Terms shall not exceed the amount you paid for the program tier giving rise to the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless Profitability IRL, Cultivate Media Co LLC, and their affiliates from and against any claims, damages, obligations, losses, liabilities, and expenses arising from your violation of these Terms or misuse of our programs or websites.

11. Privacy

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to binding arbitration in Atlanta, Georgia.

13. Entire Agreement
